1. Acceptance of Terms

By downloading, installing, creating an account, or using TastyNote (the "App"), you agree to these Terms and Conditions. If you do not agree, do not use the App. These Terms include the Acceptable Use Policy (§8), our Content Moderation and Reporting process (§9), and our Copyright/DMCA Policy (§10), which are part of this agreement. Use of the App is also governed by Apple's Standard Licensed Application End User License Agreement (Apple Standard EULA) and the App Store terms of service.

2. Who We Are

TastyNote is developed and operated by Mariano Pesallaccia, an independent developer based in Buenos Aires, Argentina ("we," "us," or "our"). Contact: support@tastynote.food.

3. The Service

TastyNote is a recipe organization and meal-planning app that lets you create and store recipes, plan meals and shopping lists, share content with your household, and generate or import recipes with AI (Pro feature).

4. Eligibility & Age

  • You must be at least 13 years old to create an account.
  • If you reside in the EU/EEA or the UK, you must be at least 16, or have consent from the holder of parental responsibility.
  • You represent that the information you provide is accurate and complete.

5. Accounts & Security

  • You may register with email/password or Sign in with Apple.
  • You are responsible for keeping your credentials confidential and for all activity under your account.
  • Notify us immediately of any unauthorized use.

6. Subscriptions & Payments

  • TastyNote Pro is offered as a monthly or annual subscription unlocking AI and premium features.
  • Payment is charged to your Apple ID account upon confirmation of purchase.
  • The subscription auto-renews unless you turn off auto-renew at least 24 hours before the end of the current period, via your Apple ID settings.
  • Refunds are governed by Apple's App Store refund policy. No refunds for partial periods.
  • The free tier allows manual recipe creation/management and basic planning; AI requires Pro.

7. Your Content & License

  • You retain all rights to the recipes and content you create or upload ("Your Content").
  • You represent and warrant that you own or have all rights, licenses, and permissions necessary to Your Content and to grant the license below, and that Your Content does not infringe or violate any third party's rights (intellectual property, privacy, publicity, or otherwise), and does not violate any law or these Terms.
  • Imported / third-party content: Some features let you import or generate recipes from external sources (for example, from a link or a video via our AI tools). You are responsible for ensuring you have the right to import, store, and (if you choose) publish that material. Do not import or upload photographs, text, or other content owned by third parties unless you have permission or the use is otherwise lawful. TastyNote does not pre-screen imported content and is not the author of content you import.
  • License: You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt (e.g., format or translate), and display Your Content, and to sublicense these rights to our service providers (such as cloud hosting, search, and AI providers) solely to operate, provide, secure, and improve the service, including synchronizing your content across devices and, where you choose to share, displaying it to your household or publicly. This license ends when you delete Your Content or your account, except for (a) content others have shared or copied, (b) backups retained for a limited period, and (c) where retention is required by law.
  • Feedback: any suggestions you send us may be used without restriction or obligation to you.

8. Acceptable Use

You agree not to use the App to create, upload, import, store, share, or make available content, or engage in conduct, that:

  • is illegal, or promotes or facilitates illegal activity;
  • infringes or misappropriates any patent, trademark, trade secret, copyright, or other intellectual property or proprietary right;
  • violates anyone's privacy, publicity, or data-protection rights, or discloses another person's personal information without consent;
  • is child sexual abuse material (CSAM) or sexualizes minors in any way;
  • is hateful, harassing, threatening, defamatory, or incites violence;
  • contains malware, viruses, or malicious code, or attempts to gain unauthorized access to the App, other accounts, or our systems;
  • scrapes, reverse-engineers, or uses automated means to access the App outside its intended use;
  • impersonates any person or entity, or misrepresents your affiliation;
  • circumvents usage limits, security, or content-moderation measures; or
  • interferes with or disrupts the App or other users.

We may investigate and take any action we consider appropriate for violations, including removing content and suspending or terminating accounts.

9. Content Moderation & Reporting

  • We use automated and/or manual moderation to detect and act on content that may violate these Terms or the law, including text and images. We may remove, disable, restrict, or refuse to display any content, with or without notice, at our discretion.
  • We have no obligation to monitor all content, and we are not responsible for content created or shared by users. We act as a host/intermediary for user content.
  • Reporting: If you believe content in the App is illegal, infringing, or violates these Terms, email support@tastynote.food with a description of the content, where it appears, and your contact details. For copyright specifically, follow §10.
  • We aim to review valid reports promptly and will take the action we consider appropriate, which may include removing content and notifying the affected user where required.

10. Copyright & DMCA Policy

We respect intellectual property and respond to clear notices of alleged copyright infringement.

  • To file a notice, email support@tastynote.food with the subject "Copyright Notice" and include: (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the material claimed to be infringing and information reasonably sufficient to locate it (e.g., recipe URL or username); (4) your contact information; (5) a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act on the owner's behalf.
  • Counter-notice: If your content was removed and you believe it was a mistake or misidentification, you may send a counter-notice with similar information, including your consent to jurisdiction as required by law.
  • Repeat infringers: We will, in appropriate circumstances, disable or terminate the accounts of users who repeatedly infringe or are repeatedly the subject of valid infringement notices.

11. Cloud Storage & Content Visibility

Your recipes and plans are stored in cloud infrastructure to enable synchronization. We apply reasonable security measures, but no system is 100% secure and we do not guarantee absolute confidentiality of content stored on our servers. By marking a recipe "public", you instruct us to display it to other users and, potentially, on the public web; you are responsible for the content you make public. Do not upload sensitive personal information you would not want stored in the cloud.

12. AI-Generated Content

  • AI-generated recipes are provided for informational purposes only. We do not guarantee their accuracy, safety, or quality.
  • You are responsible for reviewing each recipe before cooking and for checking allergies and dietary restrictions.
  • AI output may be inaccurate, incomplete, or resemble existing works; you are responsible for reviewing it and ensuring your use does not infringe third-party rights. Your use of AI features is also subject to our AI provider's policies.
  • Content you generate with AI becomes yours; we claim no ownership of it.

13. Household Features

  • You can create or join a household to share recipes and plans. Shared content is accessible to all members.
  • Roles (owner, admin, member) govern management. When you leave a household you lose access to shared content.

14. Intellectual Property

The App, including its code, design, and trademarks, belongs to us. You may not copy, modify, or distribute it. Third-party features are governed by their own licenses.

15. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Mariano Pesallaccia (TastyNote) and our service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content or content you import, upload, or share; (b) your use or misuse of the App; (c) your violation of these Terms or any law; or (d) your violation of any third-party right, including intellectual property or privacy rights. We may assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate. If you are a consumer, this section applies only to the extent permitted by applicable consumer-protection law.

16. Disclaimers & Limitation of Liability

  • As is: The App and all content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the maximum extent permitted by law.
  • Health & safety: recipes are for guidance only. We do not verify their accuracy or safety and are not responsible for AI errors in ingredients or times, allergic reactions, food-borne illness, or accidents or damage while cooking. Use common sense and proper food-safety standards.
  • Availability: we aim for high availability but do not guarantee uninterrupted service or freedom from data loss; we may modify or discontinue features.
  • User content: We are not liable for content created, imported, or shared by users, or for any infringement or harm caused by it.
  • Cap: to the maximum extent permitted by law, our total liability will not exceed what you paid for the service in the past 12 months. For free users, our aggregate liability is limited to USD 50 or the minimum permitted by law. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, to the maximum extent permitted by law.
  • Nothing here excludes liability that cannot be excluded by law (e.g., for fraud or gross negligence) or mandatory consumer rights.

17. Termination

You may close your account at any time from the App settings or by contacting us. We may suspend or terminate your account if you violate these terms, the Acceptable Use Policy (§8), or engage in fraudulent or illegal activity, and we may terminate the accounts of repeat infringers (§10). On termination you lose access and your data may be deleted after a grace period; active subscriptions are governed by App Store policies.

18. Notice for EU/EEA Users (Digital Services Act)

  • Point of contact: For matters under the EU Digital Services Act, you can reach us at support@tastynote.food (communications in English or Spanish).
  • Notice and action: You can report illegal content as described in §9. We will handle notices diligently and in a non-arbitrary manner.
  • Statement of reasons: Where we remove or restrict your content or account for legal or policy reasons, we will inform you of the main reasons where required by law, and you may contact us to contest the decision.

19. Changes to These Terms

We may update these terms. We will notify you of material changes via in-app notice, email, or by updating the "Last Updated" date. Continued use constitutes acceptance.

20. Governing Law & Dispute Resolution

  • These terms are governed by the laws of the Argentine Republic.
  • Please contact us first to resolve any dispute informally.
  • Disputes are submitted to the ordinary courts of the City of Buenos Aires, Argentina. If you are a consumer, you keep the mandatory protections and the courts of your place of residence that the law affords you.

21. Apple App Store

These terms are between you and us, not Apple. Apple is not responsible for the App or its support. Apple and its subsidiaries are third-party beneficiaries and may enforce these terms with respect to your use of the App.

23. Miscellaneous

These terms are the entire agreement. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these terms without our consent; we may.
